By using the Site in any manner, including but not limited to visiting or browsing the Site, you (the “User” or “you”) agree to be bound by this Agreement, including those additional terms and conditions and policies referenced herein and/or available by hyperlink. This Agreement applies to all users of the Site.
This Agreement sets forth the terms and conditions that apply to the use of this Site by User. By using this Site, User agrees to comply with all of the terms and conditions stated herein. The right to use this Site is personal to User and is not transferable to any other person or entity. User shall be responsible for protecting the confidentiality of User’s account information including password(s), if any. User acknowledges that, although the Internet is often a secure environment, sometimes there are interruptions in service or events that are beyond the control of Dentishop, and Dentishop shall not be responsible for any data lost while transmitting information on the Internet. While it is Dentishop’s objective to make the Site accessible 24 hours per day, 7 days per week, the Site may be unavailable from time to time for any reason including, without limitation, routine and technical maintenance. You understand and acknowledge that due to circumstances both within and outside of the control of Dentishop, access to the Site may be interrupted, suspended or terminated from time to time.
Dentishop shall have the right at any time to change or discontinue any aspect or feature of the Site, including, but not limited to, product line, pricing, content, hours of availability and equipment needed for access or use.
The Site is neither intended for nor designed to be used for submission of personally identifiable information by anyone who is less than 18 years of age. We do not collect personally identifiable information from anyone we actually know is a minor under the age of 13. If the Site becomes aware that any minor is submitting or has submitted personal information to the Site without parental consent, we will close the account and delete any personal information within our control as soon as possible. In addition, for purposes of the Children’s Online Privacy Protection Act (“COPPA”), the Site makes the following statement: the Site is not directed to or intended for persons under the age of 13. Dentishop reserves the right at all times to discontinue or modify any of our Terms of Use and/or our Privacy Policy as we deem necessary or desirable. Such changes may include, among other things, the adding of certain fees or charges. If Dentishop makes any substantial changes, Dentishop will notify the User by sending the User an e-mail to the e-mail address that is registered with the User account and/or by posting notice of the change on the Site. Any changes to these Terms of Use will be effective upon the earlier of our dispatch of an e-mail notice to you or our posting of notice of the changes on our Site. We suggest to you, therefore, that you re-read this important notice containing our Terms of Use and Privacy Policy from time to time in order that you stay informed as to any such changes. Prices are subject to change without notice. Orders may be unilaterally canceled by us if a product is out of stock. Dentishop reserves the right to cancel or refuse to fulfill any orders at any time, thus, a purchase agreement is created only upon Dentishop’s confirmation and/or approval of the order.
Orders completed by 2:00 P.M. (PST) on business days are processed the same day.
Orders completed after 2:00 P.M. (PST) will be processed on the next business day. Weekends and holidays are excluded.

Copyright, trademarks, and all other proprietary rights provided by Dentishop, its affiliates, subsidiaries, the compilation of data on the Site, and the order, sequence and arrangement of this Site, all belong to Dentishop, other partners or licensors. The content is protected from unauthorized copying and dissemination by copyright law, trademark law, international conventions, and other intellectual property laws and may not be reproduced, republished, transmitted, distributed, or used on any other website.
Dentishop is a registered trademark.
The use and registration of the Dentishop name is exclusively reserved to Dentishop. You may not register, nor use the Dentishop name, statutory name, trade name, domain name or other name, indication or description, that includes the Dentishop name or any other registered trademark owned by Dentishop.
IN NO EVENT SHALL DENTISHOP, AND (AS APPLICABLE) DENTISHOP’S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES OR DENTISHOP’S SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER, WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, COMPENSATORY, CONSEQUENTIAL, AND/OR INCIDENTAL, ARISING OUT OF OR RELATING TO THE CONDUCT OF YOU OR ANYONE ELSE IN CONNECTION WITH THE USE OF THE SITE, DENTISHOP’S PRODUCTS, OR THIS AGREEMENT, INCLUDING WITHOUT LIMITATION, LOST PROFITS, BODILY INJURY, EMOTIONAL DISTRESS, OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
DENTISHOP’S LIABILITY, AND (AS APPLICABLE) THE LIABILITY OF DENTISHOP’S SUBSIDIARIES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO DENTISHOP IN THE THREE (3) MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B) $100.
User agrees to defend, indemnify and hold harmless Dentishop, its affiliates, subsidiaries, brand licensees, other partners and suppliers and each of their respective officers, directors, employees, shareholders, legal representatives, agents, successors and assigns, from and against any damages, liabilities, costs and expenses (including reasonable attorneys’ and professionals’ fees and litigation costs) that arise out of the posting, content, or transmission of any message, data, material or any other user content you submit on the Site or any violation of these Terms of Use by you. In connection with the foregoing release, User hereby waives California Civil Code Section 1542 (and any similar provision in any other jurisdiction) which states: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.”
Terms of Use include the Dentishop’s Privacy Policy, which is incorporated herein by reference. If you object to any of these terms or the Privacy Policy, do not access and/or use the Site.
These Terms, including the Privacy Policy, are subject to change by Dentishop at any time. We will notify you about significant changes in these Terms of Use by sending a notice to the email address registered in your account, or by placing a prominent notice on our Site, so that you can choose whether to continue using our Site. Changes or clarifications will take effect immediately upon posting of the updated Terms of use on our Site. You should periodically check the Site for updates. Any use of the Site or the Products (as defined below) by you after the effective date of any changes will constitute your acceptance of such changes.
By posting communications on or through this Site. User shall be deemed to have granted to Dentishop a royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display the communication alone or as part of other works in any form, media, or technology whether now known or hereafter developed without territorial or time limitations, and to sublicense such rights through multiple tiers of sublicensees.
Dentishop reserves the right in its sole discretion to suspend and/or terminate your access to all or part of the Site, to close your account from the Site, and/or to terminate your registration, for any reason or no reason, with or without notice. If Dentishop terminates your registration, Dentishop has no obligation to notify you of the reason, if any, for your termination.
Dentishop is in no way responsible for the content of any site owned and operated by a third party that may be linked to the Site via hyperlink, whether or not such hyperlink is provided by the Site or by a third party in accordance with the Terms of Use. Any link on our Site to another site is not an endorsement of such other site and no judgment or warranty is made with respect to the accuracy, timeliness, or suitability of the content of any site to which the Site may link, and we take no responsibility therefor.
By using this Site, User agrees that: (1) any claim, dispute, or controversy User may have against Dentishop arising out of, relating to, or connected in any way with this Agreement, this Site, or any Microsite, or the purchase any product(s), shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) and conducted before a single arbitrator pursuant to the applicable Rules and Procedures established by AAA (“Rules and Procedures”); (2) the arbitration shall be held at a location determined by AAA pursuant to the Rules and Procedures (provided that such location is reasonably convenient for User), or at such other location as may be mutually agreed upon by User and Dentishop; (3) the arbitrator shall apply California law consistent with the Federal Arbitration Act and applicable statutes of limitations, and shall honor claims of privilege recognized at law; (4) there shall be no authority for any claims to be arbitrated on a class or representative basis; arbitration can decide only the User’s and/or Dentishop’s individual claims; and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; (5) in the event that the User is able to demonstrate that the costs of arbitration will be prohibitive as compared to the costs of litigation, Dentishop will pay as much of the User’s filing and hearing fees in connection with the arbitration as the arbitrator deems necessary to prevent the arbitration from being cost-prohibitive; and (6) with the exception of subpart (4) above, if any part of this arbitration provision is deemed to be invalid, unenforceable or illegal, or otherwise conflicts with the Rules and Procedures established by AAA, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, subpart (4) is found to be invalid, unenforceable or illegal, then the entirety of this Arbitration Provision shall be null and void, and neither User nor Dentishop shall be entitled to arbitrate their dispute. This Agreement and/or Terms of Use and any operating rules for Dentishop established by Dentishop, constitute the entire agreement of the parties with respect to the subject matter hereof. No waiver by either party of any breach or default hereunder is a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall be of no legal force or effect. If any provision of this Agreement is held invalid by a court of competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions contained in this Agreement, and the remaining portions of this Agreement shall continue in full force and effect. The failure of either party to exercise any of its rights under this Agreement shall not be deemed a waiver or forfeiture of such rights or any other rights provided hereunder.

Currently, there are no fees or charges associated with using the Site other than changes for purchases of Dentishop products.
